Once Andrew Barcenas LLC and its clientele agree on which services will be provided, Andrew Barcenas LLC will draft a detailed contract PDF that includes these terms and conditions and send it via email to the event-organizing party or coaching client. This contract needs to be digitally signed and returned.

Payment

Workshop tuition must be paid in full at least one month before the workshop takes place. The relevant payment information is provided in contract PDFs. 

Personal coaching tuition may either be paid in two payments (first due before the first session, second due before the latter half of the coaching package starts) or paid in full before the first session. Clients who pay in full will receive a 5% discount. 

Acceptable forms of payment are checks, Venmo, and PayPal.

Specific Terms for Team Workshops:

This agreement, between coach trainer, Andrew Barcenas, and the purchasing client(s), is valid from the time of purchase and onward indefinitely. The workshop will take place on the days they schedule within the scheduling platform. Each workshop will be spread out over the course of 1-3 days until all hours of the workshop training are concluded. The client is responsible for (1) blocking out the time for the workshop, (2) ensuring attendance of their team, and (3) securing a professional location to host the workshop.

SERVICES.  The services to be provided by the coach to the client organization are in-person, as jointly designed by the coach and client(s).  The tuition for the Primary Coach Training Workshop is $499.00 per person, and the tuition for the Elite Coach Training Workshop is $749.00 per person.  The number of organizational recipients of coach training is specified at the time of purchase. If a client organization needs to add additional workshop participants, they will need to communicate their needs to contact@andrewbarcenas.com.

ADDITIONAL FEES. If travel and accommodations are necessary for hosting the workshop facilitator, the client organization shall reimburse Andrew Barcenas LLC for lodging, travel, car rentals, and a $50 food stipend for each day of the duration of the workshop. Andrew Barcenas LLC will provide any and all receipts associated with these expenses, electronic or otherwise.

WORKSHOP ATTENDEE DISCOUNTS. As a part of this workshop, Andrew Barcenas LLC is committed to giving workshop attendees a discount on coaching packages of up to 8 sessions. For the 2025-2026 season, the discounted rate will be $119/session versus a normal rate of $149/session. After 8 sessions, workshop attendees are subject to the normal rate. This discounted offer will expire a year from the end date of the workshop.

SCHEDULING. A scheduling client or organization must receive access to the Andrew Barcenas LLC Calendly to schedule a workshop. Scheduling a workshop can be done as far as 12 months into the future.

RESCHEDULING.  Rescheduling of a workshop must be made at least two weeks in advance of the event. Any travel-related rescheduling costs shall be covered by the client organization. The first reschedule will have no reschedule fee. If a SECOND reschedule is needed, a $200 RESCHEDULE FEE will be applied to the total cost of the workshop in an additional invoice.

CANCELLATION/RETURN. In the case of cancellation/return, a full refund will be given, except for a $500 non-refundable deposit and any travel-related cancellation fees. If a refund is requested within 24 hours of ordering, a full refund, including the “non-refundable” deposit, will be given. If Andrew Barcenas LLC initiates the cancellation, like in the case of illness or emergency, a full refund will be provided, including the non-refundable deposit and any other fees. 

LIMIT OF LIABILITY. YOU EXPRESSLY UNDERSTAND AND AGREE THAT ANDREW BARCENAS LLC SHALL NOT BE LIABLE TO YOU FOR:

(A)          ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU OR ANY TRAINEE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY.  THIS SHALL INCLUDE, BUT NOT BE LIMITED TO, ANY PERSONAL INJURY, EMOTIONAL DISTRESS, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSS;

(B)          SOME JURISDICTIONS AND STATES PRECLUDE LIMIT OF LIABILITY CLAUSES.  IN THE EVENT DAMAGES ARE ASSESSED, THE LIMIT OF LIABILITY FOR ANDREW BARCENAS LLC SHALL NOT EXCEED THE TOTAL AMOUNT OF THE SERVICE PROVIDED TO THE LICENSEE OR THIRD PARTY. 

(C)AS A COACH TRAINER, I WILL NOT TELL TRAINEES WHAT TO DO WITH THEIR CLIENTS OR EMPLOYEES, AND THEY, AS MY CLIENTS, ARE ALWAYS EMPOWERED TO CHOOSE AND ARE HELD RESPONSIBLE FOR THEIR ACTIONS AND WORDS.  THE TRAINEES ASSUME ALL RESPONSIBILITY FOR ANY ACTION TAKEN ON ACCOUNT OF A COACHING LESSON, AS WELL AS ALL OUTCOMES AND RESULTS.

(D)          IN THE EVENT THAT A TRAINEE DIVULGES INFORMATION THAT I DETERMINE THAT THE TRAINEE IS A RISK TO HIM/HERSELF OR OTHERS, I AM LEGALLY RESPONSIBLE TO NOTIFY THE APPROPRIATE PERSONNEL.

THE LIMITATIONS ON ANDREW BARCENAS LLC ABOVE SHALL APPLY WHETHER OR NOT ANDREW BARCENAS LLC IS NEGLIGENT OR HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

THE PURCHASE OF ANY COACH TRAINING WORKSHOP INDICATES A FULL UNDERSTANDING AND AGREEMENT WITH THE INFORMATION ABOVE.

Specific Terms for Personal Coaching:

This agreement, between coach Andrew Barcenas and the purchasing client(s), is valid from the time of purchase and onward indefinitely. The coaching sessions will take place on the days they schedule within the scheduling platform. Each session lasts UP TO 45 minutes but may vary in length depending upon necessity. 

SERVICES.  The services to be provided by the coach to the client are in-person or tele-coaching via ZOOM, as jointly designed by the coach and client. Only LOCAL (Portland, OR) clients have the option to participate in in-person coaching sessions. Should local clients opt for in-person sessions, the sessions will take place at a mutually agreed location, as Andrew Barcenas LLC does NOT have a dedicated office space for coaching sessions. Andrew Barcenas LLC also reserves the right to redirect in-person appointments to online appointments if it deems it necessary. The tuition for the 8-session program is $1,192.00, and the tuition for the 12-session program is $1,788.00.

SCHEDULING. A scheduling client(s) must have access to the Andrew Barcenas LLC Calendly to schedule coaching appointments. Coaching appointments can be scheduled as far as 6 weeks in advance. 

RESCHEDULING.  Rescheduling/cancellation of an appointment must be made 24 hours in advance.  Please make every effort to do so. The first time a session is missed (not cancelled but also not attended), I will not charge you for it.  The second and every subsequent time, the session counts as a full session.

CANCELLATION OF COACHING PACKAGE. If at some point in the coaching partnership, a client wishes to discontinue the service, they may save their coaching appointments for a later time or simply donate their sessions to someone of their choice. No refunds will be issued after the first session. This policy is in place to increase client buy-in and raise the stakes in the coaching process. Clients will take their coaching work, actions, growth, and goals seriously if they are monetarily invested and committed. The principle is that once someone decides to grow, improve, accelerate, and advance their life, there is no going back. At least not during their partnership with Andrew Barcenas LLC. 

LIMIT OF LIABILITY.  YOU EXPRESSLY UNDERSTAND AND AGREE THAT ANDREW BARCENAS LLC SHALL NOT BE LIABLE TO YOU FOR:

(A)          ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY.  THIS SHALL INCLUDE, BUT NOT BE LIMITED TO, ANY PERSONAL INJURY, EMOTIONAL DISTRESS, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSS;

(B)          SOME JURISDICTIONS AND STATES PRECLUDE LIMIT OF LIABILITY CLAUSES.  IN THE EVENT DAMAGES ARE ASSESSED, THE LIMIT OF LIABILITY FOR ANDREW BARCENAS LLC SHALL NOT EXCEED THE TOTAL COACHING PACKAGE PURCHASE AMOUNT TO THE LICENSEE OR THIRD PARTY. 

(C)     AS I COACH, I WILL NOT TELL YOU WHAT TO DO, AND YOU, AS THE CLIENT, ARE ALWAYS EMPOWERED TO CHOOSE AND ARE HELD RESPONSIBLE FOR YOUR ACTIONS.  THE CLIENT ASSUMES ALL RESPONSIBILITY FOR ANY ACTION TAKEN ON ACCOUNT OF A COACHING SESSION, AS WELL AS ALL OUTCOMES AND RESULTS.

(D)          IN THE EVENT THAT THE CLIENT DIVULGES INFORMATION THAT I DETERMINE THAT THE CLIENT IS A RISK TO HIM/HERSELF OR OTHERS, I AM LEGALLY RESPONSIBLE TO NOTIFY THE APPROPRIATE PERSONNEL.

THE PURCHASE OF ANY PERSONAL COACHING PACKAGE INDICATES A FULL UNDERSTANDING AND AGREEMENT WITH THE INFORMATION ABOVE.
